THIS NOTICE DESCRIBES HOW MEDICAL INFORMATION ABOUT YOU MAY BE USED AND DISCLOSED AND HOW YOU CAN GET ACCESS TO THIS INFORMATION. PLEASE REVIEW IT CAREFULLY.
Who this Notice applies to
Modern Therapy Group is a covered entity under the Health Insurance Portability and Accountability Act of 1996 (HIPAA). This Notice describes our privacy practices and your rights with respect to your Protected Health Information ("PHI").
How we may use and disclose your PHI
Without your specific written authorization, we may use and disclose PHI for:
Treatment — coordinating your care among Modern Therapy Group clinicians and, when clinically appropriate, with other providers involved in your care.
Payment — billing your insurance carrier, processing copays, and verifying coverage.
Health care operations — quality assurance, training, credentialing, business management, audits.
We may also use or disclose PHI without your authorization in the following situations as permitted by law: required by law, public health activities, abuse/neglect reporting, judicial and administrative proceedings, law enforcement, workers' compensation, threats to health/safety, military/national security, organ donation, research (with safeguards), and coroners/funeral directors.
Psychotherapy notes are held to a higher standard. We will not disclose them without your written authorization except in very limited situations defined by HIPAA.
For uses or disclosures not described above, we will obtain your written authorization. You may revoke that authorization at any time in writing.
Your rights
You have the right to:
- Inspect and copy your PHI maintained by us, subject to limited exceptions
- Request amendment of your PHI if you believe it is incorrect or incomplete
- Request an accounting of disclosures of your PHI made by us in the prior six years (with exceptions)
- Request restrictions on certain uses and disclosures (we may not always be able to comply)
- Request confidential communications by alternative means or to alternative addresses
- Receive a paper copy of this Notice on request
- Be notified of any breach of unsecured PHI
To exercise any of these rights, submit your request in writing to our Privacy Officer.
Our duties
We are required by law to:
- Maintain the privacy of your PHI
- Provide you with this Notice
- Abide by the terms of this Notice currently in effect
We reserve the right to change this Notice. Changes apply to PHI we already have and PHI we receive in the future. Updated Notices will be posted in our offices and on this website.
Complaints
If you believe your privacy rights have been violated, you may file a complaint with our Privacy Officer or with the Secretary of the U.S. Department of Health and Human Services. We will not retaliate against you for filing a complaint.
